(together “Consist”, “we”, “us” and “our”) outlines in this privacy policy (“Privacy Policy”) how we(or third parties acting on our behalf) collect, use or otherwise process Personal Information (as defined below) of our customers, vendors and visitors (“you” or “your”) through this website at https://www.consist.co.il/ (the “Website”).

COLLECTION OF PERSONAL INFORMATION – GENERAL PROVISIONS. We hereby inform you, and you hereby acknowledge that you have no legal obligation to provide us with any Personal Information when you use the Website, and the provision of it is solely based on your free will. You understand that without providing your Personal Information, we will not be able to operate the Website and process your request (i.e., reply to your contact request and/or review your job application and contact you in order to give you details and provide you with a response regarding your job application).


PERSONAL INFORMATION YOU PROVIDE US WITH. We collect and process the following categories of Personal Information directly from you through the Website:

  • Personal Information relating to your exchanges with Consist as part of your contact requests through our contact form (i.e., full name, phone number, email address, company’s name, date, area of subject and content of your exchanges with Consist’ staff).

If you refuse to provide mandatory information, Consist may not be able to process your request (i.e., reply to your contact request and/or review your job application and contact you in order to give you details and provide you with a response regarding your job application).

JOB APPLICANTS

Scope. This section outlines how we collect and use your Personal Information as part of our recruitment practices. Please note that this section supplements the other sections of this Privacy Policy and applies to Israeli candidates only.

General Provisions. For the avoidance of doubt, when you apply for a position in Consist, you agree to the processing of your Personal Information in accordance with the terms of this Privacy Policy. By submitting the Personal Information at your own free will, you agree that Consist will use it to assess your suitability for the position to which you have applied; you understand that without providing your Personal Information, Consist will not be able to review your application and/or contact you in order to give you details and/or provide you with a response regarding your application.

Means of application and sources of collected Personal Information. We collect Personal Information about you (i) when you voluntarily upload your CV and related information and any other documents containing Personal Information to our Website, (ii) send such documents and information by e-mail, (iii) when you enter Personal Information directly into our online form on our Website, or (iv) by contacting us by phone.

Collected Personal Information. In addition to the Personal Information described above, we will process the following categories of Personal Information, all to the extent you provided us with any such information:

  • Biographical information, such as full name, gender, date of birth, age and professional experience.

 

  • Contact details, such as your home address, phone numbers, and personal email address.

 

  • Job-related information and qualifications, such as professional history, education, awards, qualifications, certificates, licenses, employment references, records of courses and training undertaken, and any other information you choose to provide in your resumes and/or applications.

Purposes. We may process your Personal Information for the following purposes: (i) to facilitate and manage your job application and our recruitment process, including meetings and interviews. (ii) to open and maintain your applicant records. (iii) to communicate with you. (iv) to assess your personal and professional capability and suitability for the position, including to assess your ability to perform the proposed job and to schedule an interview. (v) to comply with legal obligations including conducting equal opportunity and diversity monitoring (where permitted or required by law). (vi) to respond to law enforcement and governmental agency requests. (vii) to seek advice from lawyers, auditors and other professional advisers. (viii) to process your requests to exercise your rights. (ix) to manage pre-litigation or litigation and to establish, exercise, and defend legal and contractual rights claims. (x) to analyze and improve our recruitment process. (xi) for security purposes, including to prevent, detect, or investigate fraud, suspected or actual illegal activity, violations of Consist policy or rules, or other misconduct. (xii) retaining the Personal Information for the purpose of offering other positions and career opportunities, unless you notify us that you request the deletion of your Personal Information after we notify you that you have not been selected to the position to which you applied.

Retention Period. We will retain your Personal Information for the duration of the recruitment process. We continue to retain your Personal Information unless you ask us to delete it after the cessation of the recruitment process. We will retain your Personal Information for the purpose of offering you other positions and career opportunities, unless you notify us that you request the deletion of your Personal Information after we notify you that you have not been selected to the position to which you applied. If the Personal Information is required by Consist for legitimate interest reasons (e.g., legal disputes, prevent fraud and abuse) or Consist is under a legal obligation to do so (e.g., record keeping, accounting) – Consist shall retain Personal Information for the period required by applicable laws. In addition, Personal Information on a candidate who has been hired will continue to be retained and becomes employee, from the date of his or her employment. Your Personal Information will be stored on our information management system.


DISCLOSURE OF YOUR PERSONAL INFORMATION


We do not sell, rent or lease your Personal Information.

You hereby acknowledge and provide your informed consent that in connection with the purposes set forth in this Privacy Policy we may share and/or otherwise transfer the Personal Information to other third parties, as follows:

  • Group Affiliates. We may work through our affiliates for business and operational purposes.

 

  • Third Parties Providing Services on Our Behalf. We may work with authorized suppliers, service providers and other contractors to operate the Website. SECURITY. We endeavor to maintain appropriate technical and organizational measures to protect Personal Information in particular, against accidental, unlawful or unauthorized destruction, loss, alteration, access, disclosure or use. Personal Information is stored on our internal systems, some of which are provided and/or supported by third party providers. No technology, data transmission or system can be guaranteed to be 100% secure. YOUR RIGHTS WITH RESPECT TO YOUR PERSONAL INFORMATION


General Provisions. You may have the following rights in relation to your Personal Information depending on your jurisdiction, and, in most cases, you can exercise them free of charge. We will consider all such requests and provide our response within a reasonable period and in any event within any time period required by applicable privacy and data protection laws. When you ask us to exercise any of your rights under this Privacy Policy, we may need to ask you to provide us with certain credentials to make sure that you are who you claim you are, to avoid disclosure to you of Personal Information which is related to others that you are not authorized to receive, and to ask you questions to understand better the nature and scope of data that you request. We may redact from the information we will make available to you any Personal Information related to others. In addition, we may delete your Personal Information without further notice if we are required to by applicable privacy and data protection laws.

However, we may retain certain Personal Information as deemed required by us in accordance with applicable laws, or for legitimate business reasons (such as exercise or defense of legal claims), for the duration as required under applicable laws. In addition, we may delete any Personal Information pursuant to our policies, as in effect from time to time.

 

IF YOU DO NOT PROVIDE YOUR PERSONAL INFORMATION. Please note that if you do not want to give us your Personal Information or you subsequently withdraw your consent (where applicable) and the Personal Information is necessary in order to enter a contract or pursue business relations with our supplier or customer, then we will not be able to enter into that contract or pursue our contractual relationship.

Please refrain from providing Consist any Personal Information where such information is not mandatory for exercising your rights or within the scope of the engagement between your company and Consist.


LINKS TO THIRD-PARTY WEBSITES. This Privacy policy does not address, and we are not responsible for the policies and practices of third parties. Our Website may contain links to third-party websites and platforms, such as YouTube™. Consist is not responsible for the privacy practices of such websites. Please read the terms and conditions and privacy policy of each such third party that you choose to use or interact with.

 

SOCIAL MEDIA WIDGETS. Our Website includes social media features, i.e., LinkedIn™ and Facebook™ buttons. These features collect independently your IP address and which page you are visiting on our Website, all at their own expense and liability. They will also set a cookie to enable the feature to function properly. Social media features are hosted by third-parties. Your interactions with these features are governed by the privacy policy of the company, social media platform or third-party service, providing it. Consist is not responsible for the privacy practices of such third-party. Please read the terms and conditions and privacy policy of each such third-party.  


CROSS-BORDER TRANSFER 

Processing and Storage of Personal Information. As a global organization, Consist may transfer your Personal Information to any of Consist’s affiliates worldwide, its business partners, suppliers, service providers or any other third-parties in Israel or worldwide acting on its behalf, including through cloud-based service providers worldwide, for the purposes of processing or storage of the Personal Information pursuant to this Privacy Policy.

Where the GDPR applies and we transfer Personal Information to another country outside the EEA, we will ensure that it is protected and transferred in a manner consistent with legal requirements and a mechanism approved by the GDPR.

If you are located in a jurisdiction where transfer of your Personal Information to another jurisdiction requires your consent, such as Israel, then by using the Website you provide us your express consent to such transfer or the storage, processing or maintenance of the Personal Information in other jurisdictions, understanding that in some countries the level of protection may be lower than in your country, including Israel.
